I would be most grateful if you would provide me, under the Freedom of Information Act, details in respect to the contract below.

Confidential Waste Destruction Contract

The details I require are:

  • Has confidential waste been procured via tender or framework or another means?
  • If a framework, could you confirm the name of the framework please?
  • Actual contract values of each framework/contract (& any sub lots)
  • Start date & duration of contract
  • Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?
  • Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?
  • Who is the procurement officer responsible for this contract and could you provide their email address and phone number please?
    Who is the senior officer (outside of procurement) responsible for this contract and could you provide their email address and phone number please?
  • Who is the current supplier?
  • If your current supplier is a Facilities Management/Waste/Cleaning Company, which sub-contractor services your organisation? E.g., which company's staff actually collect your confidential waste?

Thank you for your request made under the Freedom of Information Act 2000. Please find our responses below:

  • Has confidential waste been procured via tender or framework or another means?

Yes, by another means (3 quotes to a specification) as this is below the threshold for the Find a Tender Service (FTS) https://www.find-tender.service.gov.uk/Search. However we are now out to market to contract for an integrated domestic waste incorporating confidential waste with other domestic waste streams.

  • If a framework, could you confirm the name of the framework please?

It wasn't under a framework. The Integrated Domestic Waste opportunity (live) has been advertised in FTS (not under a framework).

  • Actual contract values of each framework/contract (& any sub lots)

This information is withheld under exemption Section 43(2) - Commercial interests. The information is commercial in nature and is considered confidential. The confidentiality protects the economic interest of the supplier who typically ask for contract values to be held confidentially for three years after winning a tender. If this information is released to other waste management services providers this would prejudice the commercial interest of our supplier because their pricing model would be exposed. Such disclosure would mean that a potential competitor would be in a position to use this current, commercial information to their benefit on other tenders. Exception Section 43(2) is subject to the public interest test. BGS recognises the presumption in favour of disclosing the information however it is felt that the public interest in the transparency of spending by a public body in this case is outweighed by the specific harm that could be caused to the supplier.

  • Start date & duration of contract

It is currently a one year contract (May 2021 to June 2022)

  • Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?

No this is a one-year contract expiring May 2022. We are currently out for tender on a FTS Contract Notice Advert (attached) for an integrated waste management contract that will cover this - the bidding process is currently live. This is for 24 months with options to extend 1 year + 1 year.

  • Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?

Yes - we have a live procurement project out on a FTS. A Contract Notice has been published for an integrated waste management provider. This is for 24 months with options to extend 1 year + 1 year.
